Subscription & Refund Terms

These Subscription & Refund Terms (these “Terms”) apply to the Darkwing Sentinel personal data removal service (“Darkwing,” the “Service”) offered by Duckster Digital Solutions LLC (“Duckster Digital Solutions,” “we,” “us,” or “our”). They supplement our Privacy Policy. By subscribing to Darkwing, you agree to these Terms.

1. What Darkwing Includes

While your subscription is active, we will, on your behalf:

  • Search data broker and people-search websites for listings that contain your personal information;
  • Submit opt-out, suppression, and deletion requests to those sites as your authorized agent;
  • Follow up on pending requests and re-file when a broker re-adds your information; and
  • Provide ongoing monitoring and periodic status updates through your Duckster Hub account.

2. Authorization to Act as Your Agent

By subscribing, you authorize Duckster Digital Solutions to act as your authorized agent for the limited purpose of submitting privacy, opt-out, suppression, and deletion requests to third-party websites and data brokers on your behalf. You confirm that the information you provide is accurate and relates to you (or to a person for whom you are legally permitted to act). We use that information only to perform the Service, as described in our Privacy Policy.

3. Pricing and Automatic Renewal

Please read this section carefully. Darkwing is a recurring annual subscription that automatically renews until you cancel.

  • Price: $99.00 per year (USD), plus any applicable taxes.
  • Billing cycle: You are charged $99.00 at the time of purchase for your first year of service.
  • Automatic renewal: Unless you cancel before your renewal date, your subscription will automatically renew for additional one-year terms, and the payment method on file will be charged the then-current annual price each year.
  • Renewal reminders: We will send a reminder email to the address on your account before each renewal charge.
  • Price changes: We may change the renewal price. If we do, we will give you advance notice by email before the change takes effect, so you can decide whether to continue or cancel.

4. How to Cancel

You may cancel at any time. There is no cancellation fee. To cancel, do any of the following:

  • Sign in to your Duckster Hub, open the Darkwing section, and select Manage / Cancel to reach the secure billing portal; or
  • Email us at info@ducksterds.com or call (941) 257-3270 and ask us to cancel.

When you cancel, your subscription stops renewing. Your coverage and access remain active through the end of the period you have already paid for, and you will not be charged again. Cancellation does not, by itself, entitle you to a refund of amounts already paid except as described in Section 5.

5. Refund Policy

  • 14-day satisfaction window (first term only): If you are not satisfied, you may request a full refund of your initial annual payment within 14 days of your first purchase by contacting us. This applies to your first subscription term only.
  • After the 14-day window: Because the Service involves work performed on your behalf on an ongoing basis, payments are non-refundable after the satisfaction window, except where a refund is required by law.
  • Renewal charges: To avoid being charged for a renewal, cancel before your renewal date. If a renewal charge occurs and you contact us within 14 days of that charge before substantial work has begun for the new term, we will, at our discretion, issue a refund of that renewal payment.
  • How refunds are issued: Approved refunds are returned to the original payment method through our payment processor (Stripe). Processing times depend on your bank or card issuer.

6. What We Can and Cannot Guarantee

We work diligently to reduce your online exposure, but the data broker ecosystem is outside our control. We cannot and do not guarantee that all of your personal information will be removed, that removals will be permanent, or that every site will honor an opt-out request. Specifically:

  • Some sites do not offer an opt-out, ignore requests, or are located outside the United States;
  • Brokers frequently re-list information after a removal, which is why we re-file as part of ongoing monitoring;
  • New broker sites and listings appear over time; and
  • Removal timelines are set by each third party, not by us.

Darkwing is a privacy and data-removal service. It is not legal advice, and it is not a credit-monitoring, identity-theft-insurance, or security-guarantee product.

7. Payments

Payments are processed by Stripe. By subscribing, you authorize us and Stripe to charge your selected payment method for the subscription and any renewals. You are responsible for keeping your payment information current. If a charge fails, we may retry the charge and may suspend or cancel the Service if payment cannot be collected.

8. Your Account

You are responsible for maintaining the confidentiality of your Duckster Hub sign-in and for activity under your account. Notify us promptly if you believe your account has been accessed without authorization.

9. Suspension or Termination by Us

We may suspend or end the Service if you violate these Terms, if payment cannot be collected, or if we are required to do so by law. If we end the Service without cause during a paid term, we will refund the unused, prorated portion of your most recent payment.

10. Limitation of Liability

To the fullest extent permitted by law, our total liability arising out of or relating to the Service is limited to the amount you paid us for the Service in the twelve (12) months before the event giving rise to the claim. We are not liable for indirect, incidental, special, or consequential damages. Nothing in these Terms limits any rights you have that cannot be waived under applicable law.

11. Governing Law and Venue

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. Any dispute relating to these Terms or the Service will be resolved in the state or federal courts located in Lee County, Florida, and you and we consent to the jurisdiction of those courts. These Terms do not limit any rights you may have under the Florida Deceptive and Unfair Trade Practices Act or other applicable consumer-protection laws.

12. Changes to These Terms

We may update these Terms from time to time. Updates will be posted on this page with a revised Effective Date. If a change materially affects an active subscription, we will provide reasonable advance notice by email. Your continued use of the Service after an update takes effect means you accept the updated Terms.
